Open Letter in Support of ANP on the Classification of Natural Gas Transmission Pipelines
The institutions signing this letter express their support for the initiative of the National Agency of Petroleum, Natural Gas and Biofuels (ANP) to advance in establishing criteria for defining natural gas transmission pipelines, in accordance with Law No. 14,134/2021 (New Gas Law) and within the deadlines set in its 2025–2026 Regulatory Agenda. This initiative, under the exclusive competence of ANP, is currently under Public Consultation and Hearing (No. 01/2025), enabling broad social participation, with its conclusion expected by October of this year.
The creation of an open, competitive natural gas market with a diversity of players is one of the cornerstones of the modernization of the Brazilian energy sector. For this purpose, it is essential to clearly define what constitutes a transmission pipeline.
A matter of significant relevance and a demand of several links in the gas value chain, ANP’s regulation is expected to enhance the natural gas sector with the participation of stakeholders, ensuring operational efficiency, supply security, and market liquidity.
A robust and consistent federal regulatory framework on this matter consolidates a secure legal environment to foster investments and develop the natural gas market in Brazil.
We endorse both the legality of the process in question and ANP’s authority and duty to address the matter, as established in the Federal Constitution, laws, and resolutions governing the sector. This action is also legitimate, as it ensures national treatment for an activity of general interest.
Finally, the organizations that subscribe to this document emphasize the importance of the due administrative process of ANP Public Consultation and Hearing No. 01/2025 as the appropriate instrument for transparent and effective dialogue, with the submission of contributions to improve the Draft Resolution, in pursuit of regulation that addresses existing gaps and ensures the predictability required for investments and the full functioning of Brazil’s natural gas transmission sector and market.
